Article 3 (new): (1) The Agency shall be responsible for ensuring the regulation of the public contracts system and agreements for concession of public services.

In that capacity the Agency shall be responsible for:

  • the  regulation of public contracts activities through either decisions sanctioning procedures or through didactic actions;
  • carrying out periodic evaluation of the performance of actors of the system;
  • issuing technical opinions, as need be, at the request of the Minister in charge of Public Contracts or structures concerned;
  •  proposing reforms within the framework of public contracts and concession of public services;
  • participating in the drafting of instruments in issues of regulation of public contracts and concession of public services;
  • formulating a reference system of insuring quality for public contracts execution organs;
  • ensuring the monitoring of application of decisions relating to the settlement of public contracts disputes;
  • recruiting Independent Observers by call to tender, ensuring the proper execution of their observation mission and exploiting their reports;
  • contributing to the training of actors of  the public contracts system at the request of the structures concerned;
  • making known the rules and procedures relating to public contracts through handbooks and manuals;
  • drafting and disseminating model documents and manuals of procedures;
  • providing, as need be, technical support to actors of the public contracts award system;
  • editing and publishing a public contracts analysis magazine at the end of each semester;
  • keeping and updating a card index of all actors of the public contracts award system;
  • disseminating information on public contracts to all actors concerned;
  • publishing, in the public contracts journal, invitations to tender, results of award, amounts, time-limits and preferred bidders of contracts;
  • examining, at the request of the Minister in charge of Public Contracts, petitions in consultation with the structures and actors concerned and issuing  a response to them;
  • examining, at the request of the Minister in charge of Public Contracts, appeals in consultation with the actors concerned and issuing technical opinions, where necessary;
  • collecting and centralising all documentation and statistics on public contracts in view of the setting up of a data bank;
  • ensuring the proper application of regulatory and legislative provisions aimed at facilitating access by national SME  to public procurement;
  • recruiting by call to tender, as necessary, Independent Auditors, ensuring the proper execution of their mission of annual a posteriori audit, exploiting their reports and monitoring the implementation of the related recommendations;
  • carrying out or ordering specific audits, enquiries, controls and other investigations on the award, execution and control of public contracts and concession of public services at the request of the Minister in charge of Public Contracts or structures concerned;
  • forwarding to the competent authorities cases of established violation of the regulatory provisions on public contracts;
  •  centralizing and publishing sanction decisions;
  • keeping and updating the card index of sanctioned enterprises and actors;
  •  participating in or organizing international meetings relating to the regulation of public contracts;
  • establishing cooperation ties with national and international bodies involved in the regulation of public contracts. 

(2) The Agency shall systematically forward the following documents to the Ministry in charge of Public Contracts:

  • copies of all decisions and correspondences concerning public contracts;
  • a half-yearly report on the general situation of public contracts.

(3) The Agency shall submit to the President of the Republic an annual report on the efficiency and reliability of the system of awarding, executing and controlling public contracts. Any proposal likely to improve the said system shall be indicated in the report.
