MINDFUL OF: Decision N° 2018/366 OF 20 JUNE 2018 bearing on the new public contracts
code placing the Governor as the Contracting Authority,
CONSIDERING: The terms for Open National Invitation to tender N'
05/ONIT/RDMINMAP/NWRTB/2018 of 07/02/2018 for the rural electrification of Menka Welfare Organization (MEN.W.O) village in Santa Subdivision, Mezam Division (step 1),
CONSIDERING: Several Warning correspondences issued to the contractor by the Regional Delegate of MINEE (Project Owner) and the Regional Delegate of MINMAP for
the North West on the late start of works on the project site to TALENTECH $ CO. LIMITED without any response,
CONSIDERING: Minutes of meeting held on the 14th August 2018 at the Governor's office giving seven (07) days to TALENTECH $ CO. LIMITED to mobilise and improve on the execution rate of the project.
CONSIDERING: Article 46 of the contract bearing on the termination of the contract

HEREBY DECIDES AS FOLLOWS:

1) That, Contract N° 14/C/MINMAP/RDNW/2018 of 20th APRIL 2018 awarded after open National Invitation to tender N° 05/ONIT/RDMINMAP/NWRTB/2018 of 07/02/2018 for the rural electrification of Menka welfare organization (MEN.W.O) village in Santa Subdivision, Mezam Division (STEP 1) has been CANCELLED;
2) That the said contract has been cancelled because of the breach of contractual terms by TALENTECH & CO, LIMITED as well as the gross violation of the public contracts code;
3) That the total percentage and amount of work executed so far by the contractor stands at 0.72% as against 96% of time consumed;
4) That, the said contracthas been cancelled based on article 46 of the GAG of the contract,
5) That TALENTECH & CO, LIMITED shall from the date of signature of this decision be applied the consequences as stated by the public contracts code;
6) That this decision shall be notified to TALENTECH & CO, LIMITED by the Project Owner;
7) That the Project Owner, the Regional chief of centre for ARMP-NW, the Regional Delegate of MINMAP NWR and related services, and the Chairman of the Regional Tenders Board North West are
each in theirrespective spheres of influence charged with the implementation of this decision
