Within the framework of the execution of the 2024 State Budget and following, the Public Independent Conciliator for the South West Region hereby Relaunches by emergency procedure an OPEN NATIONAL INVITATION TO TENDER FOR THE CONSTRUCTION WORKS OF THE MAIN BUILDING AND AUDITORIUM TO HOST THE SERVICES OF THE PUBLIC INDEPENDENT CONCILIATOR, THE CONSTRUCTION OF ACCESS ROADS, IMPLEMENTATION OF WATER SUPPLY, ELECTRICITY AND TELECOMMUNICATION NETWORKS.
BY EMERGENCY PROCEDURE
The works comprise notably; THE CONSTRUCTION WORKS OF THE MAIN BUILDING AND AUDITORIUM TO HOST THE SERVICES OF THE PUBLIC INDEPENDENT CONCILIATOR, THE CONSTRUCTION OF ACCESS ROADS, IMPLEMENTATION OF WATER SUPPLY, ELECTRICITY AND TELECOMMUNICATION NETWORKS.
This involves the realization of the tasks outlined in the bill of quantities and cost estimates and elaborated in the special technical clauses comprising notably:
- Preliminary works and site installation;
- Site clearance;
- Earthworks, excavations and foundations;
- Concrete, formworks and reinforcement ;
- Building structure;
- Finishing;
- General Site Clearance;
- Electrical/ HVAC/ fire protection and security works;
Plumbing and sanitary works.
The Budget provided for the execution of the work (For all the four phases) is 1,772,507,364 (One Billion, Seven Hundred and Seventy-Two Million, Five Hundred and Seven Thousand, Three Hundred and Sixty-Four) FCFA TTC.
This Budget is divided into annual phases as follows:
Year 1: (Phase I) 360,179,650 (Three hundred and sixty million, One hundred and seventy-nine thousand, six hundred and fifty) FCFA TTC
Year 2: (Phase II) 477,304,490 (four hundred and seventy-seven million, three hundred and four thousand, four hundred and ninety) FCFA TTC
Year 3: (Phase III) 500,000,000 (five hundred million) FCFA TTC
N.B: Phase I shall be ‘’Tranche Ferme’’ while phases II, III, and IV shall be in conditional phases. Phases II, III, and IV could be awarded through mutual agreement on the basis that phase I is completed successfully.
Year 4: (Phase IV) 435,023,223 (four hundred and thirty-five million, twenty-three thousand, two hundred and twenty-three) FCFA TTC
The works which are subject of this invitation to tender are allocated into unique phase.
This Phase is organized into 4 phases or budget years as follows:
Phase I, year 1: During this phase, the preliminary works must be 100% done. Earthworks (excavation and Backfilling), concrete work for the foundations on the site must be valued at 100%. The foundation works of the Office building and auditorium must be 100% complete.
Phase II, year 2: During this phase, floors elevations works, decking (first and second floor) and Roof of the Office building of type ground floor and two stories (G+2) and auditorium (similar to ground floor and one story [G+1]) must be 100% done. Water supply (System), water supply for sanitary appliances, the water drainage and the fire network and plumbing must be rated at 50%.
Phase III, year 3: During this phase, finishing of the Office building and auditorium must be 100% done. Water supply (System), water supply for sanitary appliances, the water drainage and the fire network and plumbing must be rated at 100%.
Phase IV, year 4: During this phase, planting; external lighting, plumbing and access road (VRD) must be 100% done. All the electrical and HVAC installations and safety and security appliances must be 100% complete. Sanitary appliances, faucets and accessories and plumbing must be rated at 100%.
Participation in this invitation to tender is open to all registered Cameroonian enterprises, with the necessary technical, financial and legal capacities.
Works which constitute the subject of this invitation to tender shall be financed by Public Investment Budget of the 2024 financial year and following. Imputation N°. …2010001…

The tender file may be acquired from the Office of the Public Independent Conciliator; Tel: (+237 620 770 926) as soon as this notice is published and upon presentation of a non-refundable treasury receipt from the Regional Treasury in Buea, bearing the amount of Four Hundred thousand (400,000) FCFA. Such a receipt shall identify the concerned bidder.
Each bid drafted in English or French shall be signed by the bidder or by a duly authorized representative and presented in Seven (07) copies (one original and six (06) copies. These shall be submitted in one sealed pack containing three (3) envelopes; (A: Administrative file, B: Technical file, C: Financial file). The sealed pack shall bear no information on the enterprise, and should reach the Office of the Public Independent Conciliator in Buea latest the 03 OCT 2024 at 10:00 Am local time and should carry the inscription:

FOR THE CONSTRUCTION WORKS OF THE MAIN BUILDING AND AUDITORIUM TO HOST THE SERVICES OF THE PUBLIC INDEPENDENT CONCILIATOR, THE CONSTRUCTION OF ACCESS ROADS, AND IMPLEMENTATION OF WATER SUPPLY, ELECTRICITY AND TELECOMMUNICATION NETWORKS.
BY EMERGENCY PROCEDURE
1. The maximum duration of execution provided for by the Project Owner is twenty-four (24) months spread over a period of 4 years.
This duration is divided into four (04) phases as follows:
· Year 1: phase I (9 months)
· Year 2: phase II (8 months)
· Year 3: phase III (4 months)
· Year 4: phase IV (3 months)
Each bidder must include in his/her administrative documents, a bid bond that respects the model of this tender file, issued by a first-rate banking establishment approved by the Ministry in charge of finance, (see list in document No. 11 of this tender file), and of an amount of Thirty-Five Million, five hundred thousand (35,500,000) FCFA, valid for thirty (30) days beyond the date of validity of bids. Bid bonds for unsuccessful bidders shall be withdrawn not later than fifteen (15) days after the award of the contract and that of the successful bidder shall be retained until the required performance guarantee for good execution is provided
Under penalty of being rejected, only originals or true copies certified of financial and administrative documents, by the issuing service or administrative authorities must imperatively be produced in accordance with the Special Regulations of the invitation to tender. They must obligatorily be not older than three (3) months before the latest date set for the opening of bids.
Any bid not in compliance with the prescriptions of the Tender File shall be rejected. This refers especially to the absence of a bid bond of Thirty-Five Million, five hundred thousand (35,500,000) FCFA, issued by a first order bank approved by the Minister in charge of Finance valid for thirty (30) days after the validity of bids.
The bids shall be open in a single phase. The opening of the administrative documents, the Technical and Financial offers will take place on the 03 oct 2024 at 11.00 Am local time at the Board Room of the Office of the Public independent conciliator.
Only bidders may attend or be duly represented by a person of their choice, who has a full knowledge of the file and mandated in that capacity.
The criteria of evaluation shall be as follows:
13.1. Eliminatory criteria
· Absence or insufficient bid bond at the opening of the bids.
· False declaration or falsified documents;
· Omission of a unit price for a quantified task in the financial file;
· Non satisfaction of at least 80% of the main qualification criteria;
· Deadline for delivery Later than prescribed in the Tender File;
· A bid with the external envelope carrying a sign leading to the identification of the bidder.
13.2. Main qualification (essential) criteria: The evaluation of the bids shall be done on predefined technical criteria following the Numbering Process (“1” or “0”). The criteria relating to the qualification of candidates will indicatively be on the following:
· General Presentation of the bids, compliance with the model bid;
· Financial capacity;
· Experience (references) of the enterprise;
· Personnel to be mobilized;
· Material and essential equipment put at the disposal of the project;
· Methodology, organization of the site and relevance of proposed solutions;
· Duration of execution;
· Safety measures on the site;
· Initials signed and dated last pages of special technical clauses and administrative clauses.
The Contract shall be awarded to the bidder whose bid is in conformity with the dispositions of the tender file and on the basis of the lowest bid and technical quality, in accordance with Article 99 of the Public Contracts Code. That is, it shall be awarded to the bidder with a satisfactory technical score and the least responsive bid offer.
The bidders shall remain committed to their offers/bids for a period of ninety (90) days from the deadline set for the submission of bids.
